DUI stands for Driving Under the Influence of alcohol or drugs. Some states refer to this crime as DWI, Driving While Intoxicated. Driving Under the Influence is based upon a person's blood alcohol concentration (BAC). The DUI investigation and arrest of the driver and the determined BAC is determined either through a blood or breath test. A urine test is performed if drugs are suspected.

An Arizona DUI considers a person's ability to operate a vehicle. If the driver drinks any alcohol, and that alcohol could impair the driver’s normal ability to drive to the slightest degree. They could get convicted of a Tempe, Arizona DUI. Another type of DUI is based upon blood alcohol concentration (BAC). The legal BAC limit in Arizona is .08 for people over the age of 21. If a person has a BAC of over .08 within two hours of driving, it no longer matters if their ability to drive is affected; it is illegal to drive with that BAC in Arizona, regardless of driving ability. Even if a person's BAC is below .08, they are still guilty of DUI if they are impaired to the slightest degree.

A Tempe Extreme DUI is when the driver is found to have been operating a vehicle with a blood alcohol concentration (BAC) of .15 or above.  Additionally, if you are operating a vehicle and are pulled over by a Tempe police officer and your blood alcohol concentration (BAC) level is .20 or more, you may be charged with Super Extreme DUI in Tempe, Arizona. This charge involves much higher penalties in order to dissuade Tempe drivers from driving under the influence of alcohol.

Arizona DUI law was passed as an attempt to ensure safety on the roads of Arizona. They affect those who are found to be driving under the influence of alcohol. If one is found to have broken the DUI laws more than twice in seven years they are liable to face even tougher penalties.

For those who are under the age of twenty one, these laws are far much tougher as Arizona aggressively pursues convictions for minors who drink and drive. Additionally, Tempe and Arizona has a zero tolerance law for anyone under the age of 21. If someone under the age of 21 is suspected of drunk driving, a BAC of only .01 may be enough to warrant arrest. In other words, for a person who is under the age of 21, driving with ANY alcohol in the system is a crime even if they are not impaired.

The penalties of breaking the Tempe Arizona DUI law vary. However, Penalties get more serious and tougher for multiple Tempe DUI convictions. Breaking a Tempe DUI law repeatedly may be considered a felony. The degree of penalties given to offenders will also depend upon the amount or level of intoxication that may be found in their blood during a blood test (This is called the Blood Alcohol Concentration   – BAC). First time offenders may pay a fine, face jail term and more. They may also be forced to do hours of community work or take an education counseling class.
